Over the past decade, rapid technological development has transformed Artificial Intelligence (AI) from a futuristic concept into a practical tool widely used across various sectors. In the business world, AI is increasingly utilized for data analytics, risk management, operational automation, and algorithm-based decision-making. Meanwhile, in the public sector, governments have begun adopting AI in administrative services, healthcare systems, population data management, and policy-support decision systems.
Despite the efficiency and innovation it offers, the widespread use of AI also introduces increasingly complex legal challenges. Systems capable of making automated decisions, processing massive amounts of data, and generating predictive analyses raise fundamental legal questions, particularly concerning data protection, algorithmic discrimination, and legal accountability when AI-generated decisions cause harm. Without adequate governance and regulatory oversight, the adoption of AI may generate significant legal risks that affect not only organizations deploying the technology but also public trust in technological innovation.
Artificial Intelligence and the Transformation of Decision-Making
Artificial Intelligence refers to computational systems designed to simulate human cognitive abilities, including learning from data (machine learning), recognizing patterns, and making decisions based on predictive analysis. This capability enables organizations to process vast amounts of information far beyond human capacity, while producing faster and often more systematic decision recommendations.
In modern business practice, AI has become integral to many strategic activities. In the digital commerce sector, for example, AI powers recommendation engines that analyze consumer behavior in real time. In financial services, AI is widely used in automated credit scoring systems to assess loan eligibility through large-scale data analysis. Similarly, in human resource management, algorithm-based recruitment tools are increasingly employed to filter candidates efficiently.

From a legal perspective, legal risk refers to the potential exposure to legal liability arising from actions, policies, or decisions that violate laws, contractual obligations, or the rights of others.

Under Indonesian civil law, liability for damages may arise under the doctrine of unlawful acts (perbuatan melawan hukum) as stipulated in Article 1365 of the Indonesian Civil Code. This provision states that any unlawful act that causes harm to another party obligates the responsible party to compensate for such damage.

These frameworks collectively form the initial legal foundation for addressing risks associated with AI deployment.
